Natty Hatty — Anti-Spam, CAN-SPAM, & CASL Compliance Policy

Natty Hatty, Inc. (“Natty Hatty”) is committed to maintaining full compliance with the U.S. CAN-SPAM Act, Canada’s Anti-Spam Legislation (CASL), and global anti-spam standards.
We ensure that all email, SMS, push notifications, and platform communications are lawful, permission-based, and respectful of user preferences.
This policy applies to all communications sent via:
Natty Hatty Business Center
Natty Hatty Customer App
Natty Hatty Signature
Email notifications, reminders, alerts
Payment confirmations, receipts
Team updates, tryout notifications, and operational messages
1. Definitions
1.1 “Commercial Electronic Message” (CEM)
Any message that promotes or advertises events, services, memberships, or commercial offerings.
1.2 “Transactional or Relationship Message”
Messages required to complete a transaction or deliver a service (e.g., receipts, waivers, schedule changes).
1.3 “Consent”
Express Consent (CASL) — User explicitly agrees to receive messages.
Implied Consent — User interacts with a service in ways that reasonably allow messaging (e.g., registering for a tryout).
Natty Hatty supports both, but prioritizes express consent whenever possible.
2. How Natty Hatty Ensures Anti-Spam Compliance
Natty Hatty follows the six core principles:
No unsolicited messages
Clear identification of sender
Working unsubscribe links
Truthful subject lines
Accurate routing information
Immediate compliance with opt-out requests
3. CAN-SPAM Act Compliance
Natty Hatty complies with all requirements of the CAN-SPAM Act (15 U.S.C. §7701).
3.1 Header & Sender Accuracy
All messages display accurate:
“From” name
“Reply-to” address
Routing information
Organization name when sent on behalf of a team or facility
Natty Hatty never disguises message origin.
3.2 No Deceptive Subject Lines
Subject lines accurately reflect the message content (e.g., “Payment Received,” “Tryout Reminder”).
3.3 Identification of Commercial Content
Commercial messages include clear identification such as:
“This message was sent via Natty Hatty on behalf of [Organization].”
3.4 Physical Mailing Address
All commercial emails include a valid physical address for compliance.
3.5 Mandatory Opt-Out Mechanisms
Every marketing or promotional message includes an unsubscribe link that:
Is clear and conspicuous
Works for at least 30 days
Immediately records the opt-out
Takes effect within 10 business days (CAN-SPAM requirement)
Transactional messages do not require unsubscribe links.
3.6 No Sale or Transfer of Emails After Opt-Out
Natty Hatty does not sell or transfer emails except when required to complete a service requested by the user.
4. CASL Compliance
Natty Hatty complies with Canada’s CASL requirements, known as one of the strictest anti-spam laws globally.
4.1 Express Consent Requirements
Natty Hatty obtains express consent when:
Users create accounts
Users register athletes
Users subscribe to communications
Organizations import contact lists
Consent records include:
Timestamp
IP address
Source of consent
Method used
No pre-checked boxes are allowed (CASL requirement).
4.2 Identification Requirements
All messages include:
Sender identification
Contact information
Unsubscribe mechanism
4.3 Unsubscribe Compliance (CASL)
Unsubscribe links:
Must work for 60 days
Must be processed within 10 days
4.4 Transactional Messages Under CASL
Messages required to deliver services (waiver signing, schedules, payments, reminders) do NOT require consent and are permitted.
5. Types of Messages Sent by Natty Hatty
5.1 Transactional (No Unsubscribe Required)
Payment receipts
Registration confirmations
Tryout reminders
E-signature confirmations
Waiver completion notices
Team communication from coaches
Facility updates related to active events
Account security notifications
These are service-essential messages.
5.2 Commercial or Promotional (Unsubscribe Required)
Facility marketing campaigns
Tryout promotions
Program announcements
Membership promotions
Highlight reels or newsletters
These require:
Consent
Unsubscribe link
Visible sender identification
6. Unsubscribe / Opt-Out Process
Users may opt out by:
Clicking the unsubscribe link in any commercial email
Managing preferences in the Natty Hatty Customer App
Contacting support:

Natty Hatty processes opt-outs:
Within 10 business days (CAN-SPAM)
Within 10 calendar days (CASL)
Opt-out applies per contact, not per athlete.
7. Anti-Spam Rules for Organizations Using Natty Hatty
Organizations must follow:
CAN-SPAM (U.S.)
CASL (Canada)
GDPR’s legitimate interest rules (if applicable)
Organizations may not:
Upload purchased email lists
Send unauthorized promotional emails
Use Natty Hatty to send spam
Misrepresent sender identity
Ignore unsubscribe requests
Send messages unrelated to sports services without consent
Natty Hatty may suspend accounts that violate anti-spam laws.
8. Data Logging & Consent Recordkeeping
To support compliance, Natty Hatty logs:
Opt-in timestamps
Consent source
IP addresses
Device metadata
Opt-out timestamps
Communication logs
These logs serve as audit records for regulatory inquiries.
9. Enforcement & Violations
Natty Hatty may:
Suspend messaging abilities
Restrict organization access
Terminate accounts for repeated violations
Provide logs for legal inquiries
Report severe abuse internally
Zero tolerance for:
Purchased contact lists
Mass unsolicited messages
Automated spam campaigns
Fraudulent sender identities
